A mortgage is a contract

Signed between a lender and a borrower. In Ontario that puts it under the Consumer Protection Act, like any other consumer agreement.

The Act requires disclosure

Exact pricing, the total of every fee, and terms in plain words, before anyone signs. That is a right, not a courtesy.

Where it is missing, it can be raised

Disclosure can be put to the lender as part of a defence. Where a defence is accepted, enforcement steps may be paused while the matter proceeds.

Because a mortgage is a consumer contract, and Ontario’s Consumer Protection Act requires clear disclosure of pricing, fees and terms before signing. Where that disclosure was not given, the point can be raised with the lender as part of a defence. Whether it is available on your file depends on your documents.
